Absence during the 3 Cross Continuation Hearing

22-Jun-2026 (In Divorce Law)
I am having my 2nd cross continuation hearing for my HMOP case on 26.07.2026, and I will not be able to attend the hearing on that date, I am proceeding the case as party in person. Do I need to submit an absent petition in advance for not attending the hearing, as no one will be appearing on my behalf. What may the consequences. Can any respected advocates guide me what to do.

It is mostly advisable to attend the said hearing. If it is not possible, ask your advocate to file an adjournment petition, or else your chance of leading evidence or the cross-examination will be closed.

Since you are appearing as a party-in-person, it is advisable to file a petition seeking adjournment well in advance, clearly explaining the reason for your inability to attend on the hearing date and enclosing supporting documents, if any. As the matter is posted for continuation of cross-examination, your absence may result in closure of your evidence, forfeiture of the opportunity for further cross-examination, or the court proceeding with the matter based on available records. Therefore, do not remain absent without informing the court. If possible, arrange for an advocate to mention the matter and seek an adjournment on your behalf.

Hello Sir if you didn't attend the case on that particular day then Court can order ex-parte decree against you. after the ex-parte decree you have to file set aside Petition to re-open your case. it is advisable to attend the proceedings but if you cannot attend if valid reasons then you have to say that before the court through advocate. and it is also advisable that you better engage an Advocate to represent your case on your behalf.
