सर,मेरी शादी को 4 महीना है और मेरी पत्नी का कही शादी के पहले से अफेयर था जो अब भी जारी है ,मै बाहर रहता हु जॉब में हु और पत्नी घर पर रोज चैट और कॉल के माध्यम से प्रेमी से बाते करती है जिसका सभी सुबूत मेरे पास है जिसमें अश्लील फोटो भी है और भी पुराने बाते और फ्यूचर की बाते।
मुझे तलाक लेने की प्रक्रिया बताइए,,क्या 1 शादी के 1 साल पहले भी संभव है तलक दाखिल करना?

Ye Hindu Vivah Adhiniyam 1955 ki Dhara 13(1)(i) ke tahat 'Vyaabhichar/Adultery' ka mazboot aadhar banta hai.
Samanya niyam ye hai ki shaadi ke 1 saal tak talaq ka case file nahi kiya ja sakta - Section 14 HMA. Lekin agar koi 'exceptional hardship' ya 'exceptional depravity' ho to Court ki anumati se 1 saal se pehle bhi petition file ki ja sakti hai. Aapke case me affair aur saboot hone ke karan aap Court se chhoot maang sakte hain.
Process: Family Court me Section 13 + Section 14 ki chhoot ke liye application ke saath divorce petition file hogi. Sabooton ko CD/PDF me seal karke dena hoga. Sath me CRPC 125/ DV Act ka vikalp bhi dekha ja sakta hai. Kisi local Family Court advocate se milkar saboot check karwa lein.
