6 months marriage, wife lives seprate since 4 months

Hi, its been 6 months of our marriage, and in only 2 months of marriage we fought for almost everyday due to her previous affair opened up, and finally after 2 month of toxic relationship she went back to her old bf, it's been 4 months she has gone there, I am not sure if she is ready to give mutual consent, we had registered our love marriage as court marriage in ghzbd, with two certificate arya samaj and marriage certificate, no arrange marriage nothing no dowery nothing. How can i get divorce out of this situation. Obviously we have no child. Please help me with best possible options what all proofs i can collect to show in court we are living seperately since 4 months or 6 months so that it would be easy for us.

Hello In this very situation you have to be very cautious and moreover you have to make yourself clear that what situation you are in and after being clear you have to make a decision that what you want from your wife in future whether you want to live with her and whether you do not want to live with her, and when you are having a clear decision that you want to live with her, then you have to go for restitution of conjugal right and that can be done from your district court, either if you want to leave her then you can file a divorce petition or a petition for separation. Before filing these petition in any of this situation it is very important that you should consult a local lawyer of your own jurisdiction. And if possible you should send a legal notice to your wife., for such you can contact.

for divorce , either a contested one or a mutual one, you'll have to wait until your marriage becomes one year old. Since this marriage has been done by playing fraud om you, as your wife lied about her previous affairs etc., You may approach family court seeking annulment of this marriage
