5yrs of separation but no divorce

Hello. I got married in 2019 in Gobichettypalayam and we lived on and off for 10 months with lots of problems. Finally we got separated on the day of Diwali 2020. Now it has been almost 5 years since we got separated and she is not willing to live with me or give me mutual divorce. She tells me that she will give divorce only if he finds someone else or demand that I pay 20 lakhs (which I don't have as I am only earning 25k a month). Is there a way to divorce without paying or paying what I can?

hi Felix here, I can well understand your concern from the query raised, if you have resolved for divorce you can send a notice for divorce, followed by application for contested divorce in the family court, once all the factors have been ascertained and if the grounds are in your favour, you will receive divorce, thank you, you can contact me for further clarifications

I would highly recommend that you file for an RCR petition that is restitution of conjugal rights, so that she will be obligated to come either live with you or Divorce. This is the best option that is available considering your current scenario.

Yes definetly divorce may be granted. Not living together is a valid ground for granting divorce. Maintenance amount may be ordered however the amount can be reduced. However this depends on he facts and circumstances of the case. It can be contested. We have a valid case.
