I'm christian and a married women since 8th May 2018. I have a male boy of 2yrs age. I came to my father's house when im 6mnths pregnant till now im their in my father's home only. Reasons: my mil and husband wants the property of mine. 14pouns Gold kept in bank to settle their debts. Aftr tat They waited to confirm my pregnancy after tat they started to give mental torture. his mom told him not to take me to hospital let her parents look at her. On Anomaly scan doctor told im in a critical state of getting bleed bcz daily i had a forceful intercourse even aftr preg confirmation, climbing enough of stairs, not taking enough nutritional foods. So dr Told him tat ur wife need to be on complete rest go let her stay on her parents house. He didn't allowed me. But I called my dad and stepped out of his house only for the sake of my unborn child. till date he didn't cared for his son. he is assainating my character. I want to get divorced. Is it possible for him to get my sons custody?
In this case, presently don’t worry about child custody if your husband file any petition before court and court will decide and further Christian law per se does not have any provision for custody but the issues are well solved by the Indian Divorce Act which is applicable to all of the religions of the country. Don't worry about the custody of the child. Your husband won't get it. Regarding divorce, you can very well file a petition for divorce on the grounds of cruelty. In addition you can file petitions for maintenance and domestic violence. You are in a safe zone.

until the age of 5 years Guardian is mother is the legal Guardian continued to the mother the mother is not fit to brought up the child then only through the permission of the four only child custody if mother is a healthy mental and is able to get the child even though she is financially weak and husband is obliged to maintain the child and the mother if the mother 6:00 the court for the maintenance there is a 100% chance study to the mother only certain visitation right may be granted to the father the father approach the court not the full child custody the divorce you can proceed he was on the ground of cruelty and dissolution by your husband at appropriate Court
