125 Crpc maintenance related to int. Maintenance
03-Apr-2025 (In Divorce Law)
In a 125 Crpc case filed by a wife, in her interim maintenance application can the wife request for legal/litigation expenses and traveling expenses, rent expense? And are Legal expenses and traveling expenses combinedly known as 'Expenses of proceedings' ?
Under Section 125 CrPC, a wife can seek interim maintenance, which may include essential expenses. Litigation expenses and traveling costs can be claimed separately under ‘expenses of proceedings’ if necessary for attending court. However, rent expenses may not always be included unless justified as essential for survival. Courts decide based on the financial capacity of both parties and necessity. It is advisable to file a separate application specifying the required costs.
