USING PHOTO ON WHATSAPP STATUS & SAYING BAD THINGS

Someone has used my and my wife picture on his whatsapp status and wrote us as frauds. Thugh he ddnt used word fraud but wrote it as Fr-----. His next status said that some people are fraud and switched off their phone on asking money back. this was indirectly related to us being shamed.
I came to know about htis from our common contact and he shared the screen shot of status. I was shocked to see the same, can i take legal action againt the person, please advice. If not stopped, this person morale will be boosted and he will take it as granted. Please help.
Yes this is definitely a crime to defame you n your wife as well as using your picture without your consent n it is also stealing your images via online mode ..it attracts IT act n other offences …b in touch …
