Deliberately positioning a CCTV camera to monitor or record a neighbour’s private space, especially areas used for bathing, washing or personal activities, is a serious violation of the fundamental right to privacy guaranteed under Article 21 of the Constitution of India. Such conduct may amount to voyeurism punishable under Section 354C of the IPC and can also attract provisions of the Information Technology Act, 2000 if recording or transmission occurs. The neighbour has no legal right to surveil private areas beyond their own premises. You are entitled to demand immediate removal or realignment of the camera through a written notice. If non-compliance continues, a police complaint and appropriate legal proceedings may be initiated to restrain such unlawful surveillance and protect your dignity and privacy.
