How to get surrender passport back for tourist visa

Hi, I sold a VoIP account to a person who misused it to make scam call to USA under payday loan process. Police raided his call center n arrested and I was arrested too for selling VoIP. Later everybody got bail but court said to surrender passport in bail conditions. I want it back to travel and visit my girlfriend. Case was filed on 25 March and on 31 march I got bail. My lawyer applied to get passport back as i had hotel booking and air ticket from 11th may to 21st may which i booked in. Feb month. But court rejected my application. Please let me know what should I do to get passport back.

There are two things for receiving passport back.
one is to applied before the lower court for releasing the passport in case they reject file Cr. Mis. Application before the District and session court and lastly before the Hon'ble High Court.
The second thing is file application before the court who is grant bail for cancellation of the bail condition for surrender the passport.

As you mentioned that your application for passport release is rejected by the lower court. you need to file Criminal Misc. Application before the High Court, with a prayer for modification of the condition of the Bail. If your purpose is bona fide, then High Court will grant your application.
Also, from the facts you mentioned that you have been arrayed as an Accused in the alleged offence merely for having sold your VOIP account, do not sound genuine. Perhaps you should consider filing a Quashing Petition in the High Court, to quash the FIR/ Charges against you.
