How many days they will take to file CS

Can police file FIR without any evidence aganist me bt only on the behalf of force made by complainant to file case against me?Even CS is not filed from 8 mnths from date of filing FIR.Can police discharge me after having no evidence against me as I know I havent created any fake accnt?And how many days they will take to file CS?Can I QUASH the FIR b4 CS or wait till CS is filed?The case is abt creating fake accnt of girl which I have not made bt forcefully charged.
First of all you should contact the concerned police officer and clarify your position in the said case. Next you will have to convince and request to File a Closure Report u/s. 169 Cr. P.C. for lack of evidence and if the police are reluctant then you can approach the court with your say. Yes You can Quash the FIR itself without CS and that has to be done before High Court u/s. 482 Cr.P.C. and only the High Court is vested with the powers to quash the FIR and no other Court.

Police can file an FIR without evidence if there is witness to the evidence and on the basis of statement by the witness the police can go ahead with the FIR. The police will discharge you in case they doesn't find you guilty in the offense. It is good to hire a good lawyer to defend your position in such case
