Can I sue a company for making marketing calls even on DND mode?

Sir I am recieving marketing tele calls from credit card services hence I activated DND with my mobile number. Last call I recieved was on 29 December 2017 from the number . During last call, they told me that they will make marketing calls whenever they needed. And says there are no legal restrictions for them for making marketing calls from an un registered number.
1.You have to complaint this issue to the Telecom Regularly Authority of India. (TRAI).www.trai.gov.in.
2.This is the simple way to solve the issue. You have the right to sue the company , but it takes time and expensive.
3. Telecallers or marketing people called based on data provided to them.Some times we are giving our data at malls ,exhibitions etc for free tickets, free offers, etc with our own hand writing and signature.
4.Don't give your personnel data to any un known persons. Especially Aadhar number.
