06-Jun-2023 (In Criminal Law)
My ex-girlfriend filed a complaint against me that I forced her into sex. But, nothing like that ever happened. I have WhatsApp chat & Instagram screenshots and call recordings as proofs to prove that everything was consensual, kab kab usne force kiya h sex k liye mere postpone krne k baad bhi, and all the time she threatened to frame me by saying k mujhe use kiya and all. I just want know what to do?

if your ex girlfriend filed a complaint against you like this then u should keep save that type of things like WhatsApp chat and Instagram screenshot and also call recording toprove that everything was consensual..but if your girlfriend 's age below 18 then u will be in trouble...

If possible please tell me age of your ex girlfriend and the date and time of incident for my best advice well, based on the information you have provided, if you have evidence that suggests that the entire sexual relationship between you and your ex-girlfriend was consensual and she forced you to do the same on some occasions as well, then you have a strong defense in the case. Your WhatsApp chat and Instagram screenshots and call recordings will work as evidence to discredit the allegations of force placed upon you during examination in chief. you will have to get Electronic record certificate u/s 65B EVIDENCE ACT of those proofs what you need to do? You can either file an anticipatory bail U/S 438 CRPC or Regular bail U/S 437 or 439 plea depending upon whether or not the police have arrested you yet. Once you are out on bail, you can file a counter-complaint of defamation against your ex-girlfriend, depending on the facts of the case. Additionally, always try to cooperate with the authorities and provide them with all the required evidence and information. Thank you

Yes it is possible that your girlfriend can file a case against you. However it would be very difficult for her to prove that it was rape. Both of you had consensual sex and you have a history to show which could be your text msgs, photographs etc. However what is important here is that even you can file a case against her for blackmailing you. If she has warned you by texting you, then that text msg will be your proof for filing a case. However one should avoid such relationships as they usually end up being ugly. When over possessiveness comes in the picture and when wanting a person becomes obsession then love no more prevails. Such relations are toxic for the other person.
