Two separate cases with the same set of facts and cause of action cannot sustain. One of the cases needs to be withdrawn. Please check if the same set of facts are pleaded in the both the petitions. The second case filed can be objected and asked to be dismissed as there already exists a case for the same relief

Make sure to inform both the courts about precedency of the other maintenance petition and if possible approach the high court and get one maintenance proceedings are stayed and quashed on the ground that similar petition in a different court is pending
