When does consensual sex amounts to rape

Consensual sex, when lady know that man is married. Is a rape? Lady age is45years old. She give the statement that man promise her to marry.
Dear client if man promised to lady for marriage and made physical relation with her and not marry her then lady can file case for rape under sec 376 of indian penal code. It does not matter that whether man is married or not

No ofcourse it is not rape if any lady knows that man is married and still she is having sex with that man then it is not rape. You are advised to do not worry it is not rape case.

Legally no it won't amount to rape as held by apex court on many of the judgments.but in our judiciary one has to make allegations only whether it true or false is a matter of court trial. So if any one complaint about rape police will have to investigate the crime and one will have to face the process.
