What to do if my brother withdrew money from my deceased father a/c ?

26-Apr-2023 (In Criminal Law)
My brother withdrew money from my deceased father bank a/c , on the strength of a succession certificate which does not show our names. He fraudulently suppressed our names - me & my sister & got a succession certificate from district court showing my widow mother & him as sole heir. What steps now shall I initiate to get my share -1)Shall I complain the forgery to Police 2) move court to get justice or 3)both. Kindly advise a bit elaborately. Thanking you yours faithfully, M.Chatterjee

Sir, if you go and try to complain to the police, they may or may not take your complaint. You would be best advised to approach court u/s 156(3) crpc and make a complaint to the magistrate, who will pass specific direction for police investigation and FIR will be lodged against your brother. Please contact for more details.

I would go for 3, but many Wii opt for 1 as it comes without any legal cost. For elaborately you have to come to us, meet us. Show us the papers and tell us the exact amount he took out from your late father accounts. Maybe the legal cost can be greater than the amount that your brother took out from your's late father account. Think and then contact..

MY OPINION THAT i have gone through your matter, it reveals that it is organized forgery against you 7 your own sister, you are both genuine successors of your deceased father property / properties, as well as in at other important valuable / valuables, you should move in different legal ways at different forums.
