What remedy do i have at HC or SC by way or writ or SLP

I have been accused in a 498A matter where the investigation has been malicious and tainted based on such investigation a chargesheet has been submitted. What is the remedy available to me at High Court or Supreme Court especially by way of writ or SLP

You can apply for quashing in the honble high court to quash the charges against you .....





...but you have to prove it beyond reasonable doubt that you are falsely implicated in the FIR

You could file an application before the High Court for quashing of the FIR but then that rmedy is not viable. we can also go in against the chargesheet if no charges are made out. You will have to sit down and see how to chart it out.

Before coming to the conclusion whether you should file a writ petition or an slp in Supreme Court you should mention all facts of your case until you will not go through the merits of your case it may not be possible to get relief

The 498A would any time result in warrant, so apply for anticipatory bail first. you may approach HC for quashing of the FIR if you have sufficient material to show that there is an abuse of process of law.

Sir you have the remedy of filing a petition for quashing of the FIR / chargesheet in case either of these carry such gross improbabilities that on the face of it these are false and concocted. However your case has to be studied in detail before arriving at a final conclusion
