What is the legal process to obtain whatsapp messages?

04-Jul-2024 (In Criminal Law)
Now after almost 1.5 years of separation I have filed a divorce and after that my wife have filed false 498A, DV against me. On the day of separation my wife sent me a WatsUp message and where she said sorry and apologies because of her behavior. Also after the separation several times I had talked with my father-in-law and sister-in-law where I have clearly told that because of her physical torture towards me I can't stay with my wife. There were not even single word from them regarding any physical torture from my side or dowry related stuff. I have all these call records. So from all these call records and messages where it is clearly evident that my wife used to physically tortured and there was nothing from my side. So all these call records and messages can be used in the court? and can we get whatsapp chat history legally?

Under Indian Law, WhatsApp messages and call records can be used as evidence in court proceedings. However, the admissibility of such evidence will depend on several factors, such as the authenticity of the messages and call records, the manner in which they were obtained, and the relevancy and materiality of the information contained therein.

To establish the authenticity of WhatsApp messages and call records, the party seeking to rely on such evidence must demonstrate that the messages and call records are genuine and have not been tampered with. This can be done by producing a certificate under Section 65B of the Indian Evidence Act, 1872, which specifies the conditions that must be met for electronic evidence to be admissible in court.

Additionally, the party seeking to rely on the WhatsApp messages and call records must establish their relevance and materiality to the issues in dispute in the case. The court will consider whether the evidence is essential for determining the facts of the case and whether it is consistent with other evidence presented.

It's important to note that the admissibility of WhatsApp messages and call records as evidence is subject to the discretion of the judge hearing the case. The judge will consider all relevant factors in determining whether to admit the evidence and how much weight to give it in reaching a decision.

Yes, it can be used as an evidence as per section 65B of the Evidence Act of 1872, but the acceptance of those evidence depends totally upon the discretion of the Court how ever those evidences will be taken into consideration if it fulfill certain conditions. Thanks.

Yes such records on whatsapp are very much useful to prove before court that your wife has filed false cases against you, if you see on the right side there are 3 dots, click on it and choose email chat option and email the same to yourself and you will find attachment take print of the same and place it before court.

Yes, WhatsApp messages, call recordings, and other electronic communications can be used as evidence in court under the Indian Evidence Act, 1872 (now the Bharatiya Sakshya Adhiniyam, 2023) as amended by the Information Technology Act, 2000. To be admissible, you must prove the authenticity of such evidence, such as by providing original devices, screenshots with metadata, or by submitting a certificate under Section 65B of the Evidence Act (Section 63 of the BSA) for electronic records. If the chats and call records clearly show her abusive behaviour and absence of any dowry-related issues, they can help in your defence.
