What is process for bail in mental harassment case

None of relative and family members is included in a case with sections 302, 498A 1.can we apply for a bail what will be the process for applying for a bail 2.if we go for settlement with the complaint party it is possible for the case withdrawal 3.there is no evidence to prove that he did the crime(he is cool person does not have any cases or remark till date) how can we get him out from the case 4.is there any chances for the case cancellation from police(before/after failing charge sheet) / by court

in case of 302 there is no question of compoundable as it is grevious crime punishable with life or death and the facts you are reminding are 302B dowry death and even if you go for settlement only you can get acquital by hostiling the witnesses in the course of trial only

Most of the matrimonial issues evolve due to heat of the moment .Mostly later they repent on that.Once FIR is registered it takes long time to get the final court order.
If you wish to get compromise then you put a petition before the court for compromise.

Section 302 with 498a is a serious offence and generally courts do not grant bail unless and until the reasons for bail are so strong that the parties were not even remotely connected with the case.
a FIR can only be quashed by the high court.
Even if there is a compromise, the compromise should be presented in the high court and high court only has powers to quash a FIR with 302 and 498a offences.

Bail process is simple , please contact local ADVOCATE for further process because there is lot of section work which a normal person cannot do,until that person is well versed with the law ..If you want to settle the matter out of the court, we need to take some precautionary steps to settle the matter..
