For seeking free legal aid from the Delhi High Court Legal Services Committee (DHCLSC), you are eligible if your annual income is below the prescribed limit, which is presently ₹3 lakhs per annum for a general category applicant. Based on what you have stated, you fall within the eligibility criteria. At the time of applying for legal aid, you are generally required to submit the following documents: You will need a duly filled legal aid application form, which is available at the DHCLSC office or on its official website. Along with this, you should submit a copy of your Aadhaar card or any other government-issued photo identity proof. You will also need proof of residence, such as a ration card, voter ID, electricity bill, or rent agreement. An income affidavit is mandatory. This affidavit should clearly state that your total annual income from all sources is less than ₹3 lakhs. If you are unemployed or self-employed with irregular income, this should be specifically mentioned in the affidavit. Supporting documents, if available, such as an income certificate issued by the SDM, BPL card, or last income tax return (if filed), can strengthen your application, but they are not always compulsory if an affidavit is provided. Regarding the income affidavit, a sworn affidavit is acceptable, but in practice, the Legal Services Authorities generally insist that the affidavit be either notarised or attested by an Oath Commissioner. A plain, unsigned statement is not sufficient. To avoid any objection or delay, it is advisable to get the affidavit notarised or sworn before an Oath Commissioner at the court complex. The affidavit does not need to be registered. If your case is already pending before a court, you should also carry copies of relevant case papers such as the FIR, charge sheet (if filed), complaint, or court orders, depending on the stage of your matter. If the case has not yet been filed, a brief written note explaining the nature of your legal problem is usually sufficient. Once you submit these documents, the Legal Services Committee will scrutinise your application, and if found eligible, an advocate will be assigned to you for representation.

For legal aid, submit ID proof, address proof, income proof, and case details. An income affidavit is required and is generally accepted if sworn before an Oath Commissioner; notarization may also be accepted as per committee practice.

For DHCLSC legal aid, submit your ID (Aadhar), address proof, and case papers. You must provide an Income Affidavit on stamp paper. It must be notarized or attested by an Oath Commissioner; a simple sworn statement is not enough. Ensure it states your annual income is below ₹3 lakh.

This willful breach is actionable through contempt proceedings. Separately, the act of furnishing a false affidavit by concealing a bank account, coupled with the fabrication regarding a minor child, represents a direct assault on the judicial process. These are not mere discrepancies but potential offences, making an application under Section 340 of the Code of Criminal Procedure entirely maintainable to prompt the court to consider a formal complaint for perjury. Your most effective course of action is to deploy these grounds strategically to challenge the execution proceedings. You should immediately file a detailed objection to the execution petition, explicitly highlighting how the decree under execution is rooted in materially false evidence and was revived in blatant contravention of the binding settlement. To maximize procedural pressure, this objection should be filed concurrently with distinct applications for contempt of court and under Section 340 CrPC. This coordinated approach frames the petitioner's actions as a sustained abuse of the legal process, thereby creating a compelling foundation for the court to stay or even dismiss the execution proceedings entirely, as courts do not look favorably upon parties who seek relief through fraudulent means and broken undertakings.
