What are the consequences if FIR is filed against me.
06-Dec-2023 (In Criminal Law)
More than 2 years ago, I was in business with a guy whom I met through a common friend. He invited me into his startup company as an employee as well as a profit-sharing partner based on the amount of business I brought to him. He also advised me to bring my colleague with me from the previous company.
After a month in business, payment disputes started arising between everyone. One day, my colleagues and I decided to take things into our own hands and took whatever valuables we could from the company as per our money due. Since it was a startup, no paperwork was involved, and only my address was known to the guy as I lived nearby.
When the guy came to know about the incident, he filed an FIR against us and demanded the return of the items. I returned the valuables I had, but my colleagues didn’t. However, he still believed that I was involved with the others and pushed the police to take action against me. I was served a NOTICE which stated the following:

What happens if someone files an FIR against you? If an FIR is filed against you, and if all allegations are found to be true, you may be sentenced to jail. The complainant may institute a legal suit against you. You have not mentioned who issued the notice—whether it was from the police, a lawyer, or the court.
It is important to understand that does FIR against a person mean his career is finished? Not necessarily, but an FIR can have legal consequences, and you should handle it carefully by consulting a lawyer immediately.

What to do if FIR is registered against me? I will need more information. However, based on what you have described, the consequences of an FIR depend on the sections under which it has been filed. If the charges are serious, the police may have the power to arrest you. It is advised that you seek some kind of protective order from the Court to avoid arrest.
If you are wondering what happens when an FIR is filed against you, the police will conduct an investigation, and based on the evidence, they may proceed with filing a chargesheet. If you do not take action, it could negatively impact your legal standing.

You have committed a non-bailable offense under Section 379 and 380 IPC, which are serious theft-related charges. The FIR will contain details of the charges against you. Since these sections are non-bailable, you must contact a lawyer immediately and arrange for your bail.
If you are worried about how much time it will take for bail, it depends on case complexity and court workload. A long legal battle may start against you, so it is better to compromise with the person who reported you and try to settle the matter outside court if possible.

The issue is serious, and you must file an application for Anticipatory Bail to protect yourself from arrest. The complainant is alleging theft, but since you were a partner in the startup, the items technically belonged to you as well. Therefore, the charges may not amount to theft if you can prove your legal ownership of the items.
If you are asking, "does FIR against a person mean his career is finished?", the answer depends on how you handle the case. If the matter escalates to a conviction, it can affect job opportunities and future prospects. However, if you take proper legal action, you can prevent long-term damage to your career.
