What are the chances of quashing for FIR u/s 406,420 IPC

04-Oct-2023 (In Criminal Law)
My husband filed FIR against me allegating of stealing his mother’s jewellery and cash from her matrimonial house and then he and his mother gave affidavit to police stating that they filed FIR due to some misunderstanding and wants no action to be taken. On the basis of that affidavit police filed the Final Report. After 10 months on Final Report, my husband protested against the Final Report and it got accepted. What are the chances of quashing?

When Final report is accepted then quashing does not arise. You must share complete details like FIR affidavits final report. It is is not clear if final report is accepted it means case is closed. If if protest is accepted then case will be reopened.

If your husband protest the final report and give proper cause or evidence the magistrate can make a order of further investigation. Or you can go for quashing in high court on the ground on affidavit.
