It has been held by many courts that bail is the rule and jail is the exception. No person should be deprived of liberty unnecessarily. There are many factors that come into play when a court decides to grant bail. Bail may also be granted with conditions as to presenting sureties and bond of amount decided by the court. Factors determining bail include but not limited to:
1. Nature of offence/crime
2. Age of the accused
3. Roots in society of the accused
4. Whether there is a possibility of accused tampering evidence.

if more than 90 days have passed since FIR and no chargesheet has been filed then bail will be your right. in that case you need to apply for bail asap before chargesheet is filed

yes but come with your summon copy which may have been provided to you along with charge memo copy. we can move an bail application before the court and in such matters bail has been granted so nothing much to worry about.
