you should lodge F.I.R against the accused. it is obvious that police after bribe will not take any action against them first try with police, if there is no help you can go to the court for registration of F.I.R under section 175(3) BNSS

Did you or your any familiar person make any complaint about the incident on that time? If yes, Then if any court proceedings is pending against your parents it can be quashed in the highcourt. For further Consultant you must have to tell more about the incident and the actions taken by your family.

From a legal standpoint, the following points are relevant: 1. Cognizable Offence: The acts described—including assault with deadly weapons (bamboo sticks), causing grievous hurt, and unlawful assembly—constitute cognizable offences under the Indian Penal Code (IPC), such as: • Section 147/148 IPC (Rioting with deadly weapons), • Section 323/325 IPC (Voluntarily causing hurt/grievous hurt), • Section 307 IPC (Attempt to murder) — if intent and seriousness of injuries justify it. 2. Illegal Arrest: If your parents were injured and still arrested without proper medical attention or legal justification, it amounts to abuse of power and possibly wrongful arrest under the CrPC and constitutional provisions. The arrest without investigation or a fair hearing may attract action under Section 220 IPC (Commitment for trial or confinement of person by a person having authority who knows that he is acting contrary to law). 3. Police Misconduct & Bribery: Allegation of bribe taken by police is a grave offence. If substantiated, it may fall under Prevention of Corruption Act, 1988. You can pursue this through a complaint to the Lokayukta, Vigilance Department, or the Human Rights Commission. 4. Remedies Available: • You can file a writ petition under Article 226 in the High Court for compensation and investigation by an independent agency (CBI/SIT). • If the matter was suppressed or FIR closed unfairly, you may apply for re-investigation or re-opening under Section 173(8) CrPC. • You may also file a private criminal complaint in the concerned magistrate court under Section 200 CrPC if the police failed to act impartially. 5. Medical Records & Witnesses: Preserve any old medical records, photographs, and witness testimonies if available. These will be crucial for pursuing any legal remedy now. Please note that the limitation period does not apply to serious criminal offences like attempt to murder or police misconduct, especially if fresh evidence or miscarriage of justice is brought before the court. If you wish to pursue justice or compensation, I recommend preparing a detailed affidavit with medical reports, names of witnesses, and a factual timeline. We can then evaluate the strongest legal strategy tailored to your case. Please feel free to contact me for further assistance or legal representation.

Aapki baat se lagta hai ki yeh ek bahut hi gambhir matter tha jisme multiple log injured hue aur police action bhi biased raha. Lekin 2005 ka yeh matter kaafi purana ho chuka hai, isliye ab kisi naye criminal proceeding ki sambhavana kam hai. Lekin agar aapke paas koi medical records, FIR copy, ya injury ka saboot ho to aap Human Rights Commission ya State Police Complaint Authority me complaint kar sakte hain. Agar aapke pita ke arrest me police ki galti ya bribery involved thi, to RTI ke madhyam se details mang kar ya High Court me writ petition file karke justice ki demand ki ja sakti hai. Legal remedy available hai par uspe depend karega ki aapke paas kya evidence hai.
