Want to file cheating case against my wife

My wife leaving me 4 month ago with my 8 years male child & now living at parents home. Before she leave I have 100% funding her to make a business. The rent contract of the shop in her name. Now she sent notice to land lord that she didn't want to run the shop so want to quit & claim the security diposit.
I have all the payment details like cheque/ Bill's in my name & bank statement shown that I have funding the same.
My question is may I file a cheating case ipc 420 against my wife
You have every right to file a cheating case against your wife. But the better option will be to take over the shop and file a suit claiming ownership of the business, so that you do not loose your investment in the business.
