Videotaping without consent on private property

12-Aug-2023 (In Criminal Law)
There is a person who has videotaped our conversation with Police in his mobile without our consent, and ahs distributed it further. We do not have video tape with us but have seen it on his mobile phone. Can he be charged under CrPC for videotaping on our home premises without permission. The Police constable also is in support of that person and has taken no action or complaint from us regarding same. What steps can we take to punish that person.

In this regard, i would like to submit that the said act of video tapping is violation of Articles 20(3) and 21 of the Constitution of India. At the same time, it is pertinent to mention that there is no bar in admissibility of such video tapping for the relevant future case. For further clarity please contact.

Dear Sir/Madam,

In reference to the your query, this is to inform you that you should approach the higher police authorities and try to lodged a complaint against the culprits/suspects (as per your views). If they (higher police authorities did no action against them) did nothing against those culprits/suspects/accused person(s) than may also knock the doors of the Hon'ble Court of Law withing your reach.
Please also consult an Advocate of your choice for more.
Thanks & Regards,
Adv. Abdul Kader,
(Delhi High Court)
