07-Dec-2023 (In Criminal Law)
Police has submitted charge sheet where accused statement shows admission of guilt. There was no such statement made to police and there is no sign of accused on the statement. What is the value of such police statement of accused during trial?

it have no evidentiary value. it is just good for investigation. if the accused have not given 164 statement (confession statement) before a magistrate then there is nothing to worry about. you can challenge that statement before the police during trial time. thanks & regards

tatement made before the police has no value before the court and conviction cannot be based on the basis of such confessional statement...the is a presumption that such statement may have been recorded by the police by threatening, coercion and pressure to the accused
