HI In general if a witness turns hostile, then his statement under 161 Cr.P.C is not considered by the court and it becomes useful for the accused. However it is the judicial discretion of court to take in to account the circumstances in which the witness has turned hostile and the courts have powers to recall the witness and depose . So the lawyer of accused needs to cautious to ensure that the witness turned hostile for genuine reasons and not otherwise.
