I got interim bail within 24 hours after arrest.Police unable to file chargesheet within time frame 90 days past.Again appearing on 20.7.22 Now my question if I may go for quashing or not. Can police delay filing chargesheet upto 3 years? Can I sit for state government service examination in the mean time?

you can go for quashing of the case in which court is your case going on no you cannot get into any government exams as fir is lodged against you when checked it will show that still your case is going on what is your jurisdiction...

delay in filing of chargesheet especially if not within the statutory period is a ground for default bail not a ground for quashing per se. be that as it may if the case against you can be quashed or not would squarely depends on the facts of the case. its better to get those papers vetted before proceeding further.

1. Yes you can sit for government service examination. 2. Yes police can delay filing of charge sheet upto 3 years from the date of Filing of F.I.R. 3. Quashing is your right, I believe you should go for it, if you have enough evidence that the case is false… In HIGH COURT I MAY BE OF HELP
