Urgency in government appeal in High Cort Of Uttarakhand

28-Oct-2023 (In Criminal Law)
I am victim in gov apl in High Court UK where accused was acquited from jnr court, case is lying in same stage(admitted) from last 15 years, we filed urgency and court ordered: The applicant-complainant to the Urgency Application is not the party of the proceedings. Hence, no Urgency Application at his behest would be too maintainable. The Application (IA No. 2 of 2022) is accordingly rejected, with a liberty left open for the complainant-respondent, to do the needful, in accordance withthe law.

the Hon'ble High Court has rejected your urgency application on the ground of no locus standi in the matter as the applicant is not party in the proceeding. The court has left oppertunity to the applicant - respondent to do the needful in accordance with the law.

The court has determined that you, as the complainant-applicant, are not considered a party to the proceedings. Rejection of Urgency Application: The court has rejected the urgency application (IA No. 2 of 2022) on the basis that it is not maintainable at your behest since you are not a party to the proceedings. Liberty Granted: The court, however, has left open a liberty for you as the complainant-respondent. This means you have the freedom or permission to take necessary actions in accordance with the law. Next Steps: Emphasize the importance of consulting with legal counsel to understand the specific legal actions that can be taken in accordance with the court's order. Legal Guidance: Advise your client to seek legal advice promptly to determine the appropriate steps to be taken in light of the court's decision. A qualified legal professional can provide guidance on the available options and the best course of action moving forward.
