File a Suit for Partition Approach an authentic civil advocate and send a legal notice to your brother asking him to give your share over that property. If he denys to abide amicably, then file a Suit for Partition before competent court. Advocate Ragul Sivanand Nagercoil

First you could register an FIR. In Lalita Kumari v. Govt. of U.P. & Ors. 2013 ( 8 ) the Court have ruled that whenever a complainant approaches the police for registration of First Information Report ( FIR ) in a cognizable offence, it is mandatory for police to register. Now what are necessary ingredients for registration of FIR 1) For an offence to be registered a cause of action is necessary. The cause of action is nothing but clearly stating the date and event of an incident happening. Say in your case on 24 Jan 2022 my brother threatened then only a FIR could be registered. if a vague complainant is logged FIR could not be registered. 2) To registar the FIR ingredients of section must be met. Say in your case he trespass into your case and threatens you in this case an offence of trespass is attracted and criminal intimidation are affected. Note What if police restrains from registering FIR then approach High Court under 482 CRPC for registration of FIR or file a private complainant under 200 CRPC.
