18-Feb-2025 (In Criminal Law)
Hello, One lady and her friend threaten to my friend who is a retired army officer for liking one political post of the same building resident on society WhatsApp group. Being an army officer my friend answered back to them and one very heat and loud argument started. The lady and her friend made one video in which my friend was speaking loudly with some abusive words. What they can do with this ? What preventive actions we can take ? What will happen if they go to police with this video ?

They will try to file a false against your friend and for safety measures your friend should go an file a complaint againstcthem before they do to be safe and that if any action is registered by police then go for anticipatory bail and file a cross complaint against them

Your friend can take legal precautions by filing a complaint under Section 351 of the BNS for criminal intimidation. If the argument did not involve physical violence, the video alone may not hold strong legal weight unless it constitutes intimidation, defamation under BNS Section 356, or public nuisance. To prevent further issues, they should collect evidence of threats, avoid direct confrontation, and file a preventive complaint with the police. If the video is misused for defamation, legal recourse under the IT Act can be explored. If taken to the police, the authorities will assess the context, and unless the officer made threats or engaged in criminal behavior, the consequences may be minimal, except in cases of highly offensive language.

If the video only captures a heated argument with abusive words, it may not be enough for serious legal action. However, if threats were made, they may file a complaint under Sections 504, 506 IPC or BNSS with its new provisions. Your friend can file a counter-complaint for criminal intimidation under Section 503 IPC, stating that he was provoked. As a preventive measure, keeping records of prior threats and any other evidence is advisable. If needed, legal representation can help navigate the situation effectively.

They can report to the police under IPC 504 or 506, or share the video online, harming reputation. Your friend should stay calm, document events, seek removal, or apologize if needed. If the other party continues to cause harm or escalate the issue your friend may need to take legal action like filing a defamation suit or complaint against harassment.
