There is a case where a learned lady is on matrimonial from January till December and at the same time in a relationship with a guy from March to October. nnNow as the relationship got sour she has put 376 on the guy whom she met on Instagram. When she was in a relationship with this guy she is also on matrimonial how is this a 376 2 n case??? Can girls search for groom and take promise from another guy too then if a better guy she gets from matrimonial leave this guy and if she doesn't get good guy and thus fellow says no so 376 .. what a Law

Here intention and consent played main role if there is consensual relationship and his promise to marry her was not with an intention to deceive her. than there is no case of 376. Various high courts and Supreme court observed it. So if there is consensual relationship and intention was not malafide than you don't have to worry. on other part it is in your favour that the girl was on metrimonial so she was not serious about relationship or promise

there are recent judgements which hold that just because relationship between the girl and boy did not fructify, it does not automatically mean that section 376 will be attracted. for 376 to be attracted, there has to be a promise to marry and on the basis of that promise, physical relationship must have been established. just because the relationship did not go ahead is not sufficient for 376 to be attracted. that would be a misuse of law.
