tell me how to proceed in these situations

29-Oct-2024 (In Criminal Law)
In a criminal case no 157/2023 (incident of tearing of flexi) I am three accused with me. For that, the police issued a 41A notice to me. For that I submitted the attendance certificate to the investigating officer that I was on duty on the day of the incident. But I came to know that my name is being called along with them in the court trials. I have not received any notices from the person who has not appeared in the court so far but by post. Can you tell me how to proceed in these situations.

hi first need to see the contents of the FIR and chargesheet filed against you and its contents and if they are false then you could file quash petition in the case and also need to see whether summons were issued to you to appear in the matter

you got 41 a notice menas you are also one of the accused , and submitting your attendance certificate to police is not making you free from case, you have to prove your absence in the court of law at the stage of trial, for further information kindly contact me , I will clarify whatever doubt you have and we can proceed further

Physical presence is not mandatory to commit an offense. Anyone who abets, aids, or instigates the commission of the offense is also considered as an accused. For further assistance or suggestions, please provide more details about your issue. Feel free to contact me.
