What happens on summoning on a criminal case? Should both party ne present on summoning date? What happens if case filler is absent on date date?
if accused appears on the date fixed in summoning order then he may be taken into custody until and unless he released on bail.
if it is a state case(Registered through FIR) then presence of informent(who lodged FIR) is not necessary. However if it is a complaint case (filed privately in court) then his presence is necessary and in his absence the compliant may be dismissed. if summon has been duly served upon the accused person then it is very much necessary to appear on the date fixed otherwise the court will issue bailable warrant against the accused person in state case. In state case there is no need to appear to the complainant on the date fixed by the court. But in private complaint case it is necessary for complainant to appear on each and every date otherwise moved an application for exemption of personal appearance through the advocate. In the absence of the complainant the court can dismiss the case in default of appearance.
