Stopping of show cause notice of dismissal from service

I was convicted in cbi bribe case in lower court but I put the case in high court and same has been accepted although no hearing has started but Now after 2 yrs I got the show cause notice from department of dismissal from service ..what should I do to counter this as only 10 month left for my retirement? Pls suggest

The notice for Dismissal of service is being sent after your conviction from the lower court.
So kindly reply proper to your show cause notice and also before High court . Try to linger on it till your retirement and it is possible.

First of all you write a letter to your department citing the case number which you e filed before the Honble High Court. Thereafter you please move an application before the Honble High Court as your case is an urgent one looking at your retirement period.

First of all go and check the status of your case pending in the high court. If the matter is pending before the Hon'ble High Court , take the certified copy of your case and file the same before the department. Ask from your lawyer whether any application for stay of departmental enquiry was filed with the petition. If yes, then what's the status of that Application. Other option is to face the departmental enquiry and file your detailed reply. Department is not above the Court. So don't worry. All the best.

you can file a petition under service matter in CAT stating that your matter is pending in the High Court and appeal is admitted so the department has no right of dismissal of your service till the appeal is deposed off.
