Somebody close to me forged my signature, now I want FIR Quashed

09-Jun-2023 (In Criminal Law)
Hi,nA few days back I filed an FIR against an unknown person for forging my signature on a business document and invoice, police registered the case under section 465, 467, 471, 419. I received the payment on invoice myself and document is with our other trading partner. nBut now I have found out that the person who did my signature is someone close to me, it is just that, that person never told me about putting my signature so unknowingly and out of anger I filed the FIR, can I get this FIR quashed? Police says they can not cancel the FIR, only court can.So, all in all, in this case, no harm done, her intentions when signing were good as she is someone very close to me, to save my time and efforts as I was not in the city, she forged my signature. Will this reason be good enough to get FIR quashed? I hope she is not in troubleI am in Central Delhi, I don't know any advocate who can do this, if you are dealing with quashing of FIR in Delhi High Court, please connect with me on mail

Yes…the FIR can be quashed only in the HC on the ground that you don’t want the police to further investigate the matter and the person in good faith forged your signature and there was no wrongful loss to anyone. Kindly share your mail so that I can guide you better. For more legal assistance I am just a call away.

The FIR an be quashed on the basis of compromise at any stage by the High Court. The complainant and accused can enter into a compromise. Both the parties can file a joint petition under Section 482 CrPC for FIR quashing. Thereafter, the Court will scrutinize the facts, circumstances and aspects of the matter before passing an order for quashing of FIR. If the Court is not satisfied with the facts of the compromise, then the High Court can refuse the quashing on the basis of compromise. The parties can approach the Trial Court if the offence is compoundable and High Court has refused to quash the FIR.
