Society clicking pictures of female guests & then goons of RWA president misbehaving with complainan

18-Oct-2024 (In Criminal Law)
The society where I lived is taking pictures of not just workers but also personal guests including females. I am not comfortable with this intrusion to privacy. When I complain to the society guards who do this, the President of society RWA comes with his personal goons and they start pushing & shoving me. After I push them back, they punch me in the face. What can I do?

Dear Sir/Mam In response to this query, here is a possible legal action and advice that can be given: You have several legal rights and steps you can take to address this situation: 1. File a Police Complaint: Since the situation escalated to physical violence, you should immediately file an FIR (First Information Report) under the relevant sections of the Indian Penal Code (IPC) for assault and threat. The sections related to physical assault (Section 323), criminal intimidation (Section 506), and wrongful restraint (Section 341) may apply here. Collect any evidence, such as CCTV footage or witness statements. 2. Intrusion of Privacy: Taking unauthorized photographs of personal guests, particularly females, without their consent could be a violation of privacy laws. You may file a formal complaint with the police or take it up with the Data Protection Authority (once the Personal Data Protection Act is fully implemented). The right to privacy has been recognized by the Supreme Court of India as a fundamental right. 3. Complaint to RWA or Higher Authorities: If the Resident Welfare Association (RWA) is involved in these illegal actions, you can complain to the district registrar or any higher local government body overseeing the operations of RWAs. 4. Civil Suit for Harassment: You may also consider filing a civil suit for harassment and seek compensation for the mental and physical distress caused. It is important to consult with a legal professional to evaluate your case further and ensure the correct procedure is followed. --- This course of action should help the client seek protection and justice for the wrongs they have experienced. Let me know if you need assistance drafting any specific legal documents for this situation. Adv. Mahinder Singh Mavi
