shaadi ka jhaasa by younger boy to 38 year old female

24-Feb-2023 (In Criminal Law)
What would you say ?nnA very well crafted and fabricated FIR is given by a very well educated lady alleging of 376 on false promise to marry and she only is travelling to lukhnow to meet the guy each and everytime and the guy never went to her place in gurgaon. Now because the guy said no for marriage girl took 3 months to clearly discuss with a learned counsel and create a fabricated FIR for which she also knows there is no proof. Plus in their relationship of 6 months she placed the keyword "promise to marry" in the middle of that and proofs show that before the alleged promise to marry they are in the same room. What is your inference in this case. Fact : Girl is a senior officer in bank PO aged 38, very intelligence and saying shaadi ka jhaasa. She also gave a letter to him saying that he is good in sexual act. Does this anywhere look shaadi ka jhasa

intention and consent plays main role these kind of cases. if the boy promises to marry her with the no malafide/false intention. supreme court recently observed that it would be folly to treat every breach of promise to marry as a false promise and to prosecute a person for the offence of rape under section 376. And also observed that one cannot deny a possibility that the accused might given a promise with all seriousness to marry her, and subsequently might have encountered certain circumstances unforeseen by him or the circumstances beyond his control, which prevented him to fulfill his promise

Filling an FIR doesn't itself make any accused guilty. If the facts shown in FIR prima facie shows promises to marry and fraud is made then the FIR can be filed. But the accused need to give a proper defence to prove his case. so going through your facts, it shows that you are innocent. So fight your case on merits and produce all the necessary documents in the court.
