Sent to Jain without prior noice under section 44 for IPC 354 case

Meri behan kaa Pehle se uske sasural walo se 354A, DV, 498A etc jaise case chal rahe hai. Isi se chidke meri Behan ki saas NE mere Aur mere Bhai K uper aise allegation lagaye hai Jo 354 k under aate hai. Mera Sawal yeh hai ki kya police ko yeh rights hai ki 354 me accused ko without 41A ka notice diye bina arrest kr sake. Kyunki humne barabar investigation join ki hai. Please aap Hume advice dijiye.kya hum police k khilaf kuch kr sakte hai. Kya hum high court jaa sakte hai. Kyunki Supreme Court ka yeh order hai ki 7 saal se niche Wali dhara me notice Dena hota hai. Yeh incident 4 month purana hai. Kya hum iss pe legal action le sakte hai high Court k through. Maine aaj tak thaane bhi nhi gaya Magar police NE paise khakar mujhe jail bheja..... Please help
