You can recover your gold without penalty only if the loan is closed within the grace period mentioned in your loan agreement. If the loan is overdue, the lender is legally allowed to charge interest, late fees, and other penalties. There is no fixed number of appeals for this, as it is mainly a contractual matter.

To advise you correctly, it is important to know why the gold was seized and under which section or proceeding the penalty has been imposed. Generally, if the gold was seized during a criminal or customs/economic offence investigation, you can file an appeal before the higher authority/court challenging the penalty order. The timeline for filing an appeal is usually 30 to 90 days depending on the Act involved. If you can show that the gold was lawfully purchased, declared, or not connected with any offence, the appellate court/authority can order release without penalty.

Connect with a lawyer and file a proper reply to the show cause notices issued to you. Do brief a lawyer and seek his expert legal guidance in drafting a reply to SCN and also formulate a strategy going forward.

Yes, you can get the jewellery back. If the same is arbitrarily seized it can even be returned without penalty. It depends upon the grounds mentioned in the show cause notice. If the valid grounds were mentioned then you might have to face difficulty. There are occasions when the people are hooked for falsely pleading. Therefore, one needs to cautious while pleading for recalling the order of confiscation.
