Security cheque comes under sec 148

Hi I have given cheque for security purposes to investor who has invested 20lakh in my friends company for business purposes since my friend did not return invest amount on time my friend bounce cheque and filed sec 148 NI act I just want to know weather security cheque given comes under 148 NI act

Yes, a securety cheque can also be filed. The presumption of passing of consideration is in their favor. You have to rebut such Presumption.

it is 138 of the negotiable instruments act not 148, basically cheque is a physical property you have to disprove the transactions and given it for specific purpose , security cheque is not bad in law , but you have to counter the allegations in trial.
