Sec 323 , 504, 507 And 66 IT Act

The above mentioned section are against me and my friend in Noida. During investigation we have given our proofs and evidences due to which some other section which were there in FIR were removed by the IO. IO has not arrested us but have asked us to appear during court proceedings. Now we have got the summon for end of Nov. Just want to know, what should be our course of action which we need to keep in mind. From day one we have told the police officer to check the CCTV footage so that the whole FIR will be turned null and void. The statement in FIR and their later statement is different. Pls help. Can still they can arrest us or magistrate will grant us bail easily.

for this what in writing you have communicated to the IO that CCTV footage should be considered in the investigation has this been in 164 in ur case diary if not you can apply for arrest stay if the charge sheet has not been filed yet if charge sheet has been presented before the court then u can apply for bail.

dear client firstly like to examine your documents as in First Information Report which was filed against you and your friend now come to the point you should try to get arrest stay in the same case by the High Court and your second point is concern submission that as per CCTV footage you may not be there so subject of trial and trial court will decide later stage for more clarity contact us advocate Anurag Bhatt Allahabad High Court
