Rights of summoned accused of a financial fraud case

14-Sep-2023 (In Criminal Law)
If a government servant has been summoned to special court (cbi) as an accused/suspect while on duty, is he supposed to be sent to attend court on duty by the department? Is it legal for the department to force him to take a leave to attend to the summon?

As an accused you will not get a benefit to attend the court , you have to take leave and required to attend court only when you are attending as a witness on your official duty you will get benefit. For your question department cannot send or force you to attend unless court directed to serve from through senior officials of your department, if you haven’t attended and court initiates any action then you might face consequences.
