You can approach High Court u/s 482 CrPC for quashing/directions. If you believe police acted unfairly, you can also file a fresh application before High Court u/s 156(3) CrPC seeking direction for reinvestigation. Or file a writ petition under Article 226 before the High Court for fair investigation.

Since the police filed FR and your protest petition was treated as a complaint case, and revision was dismissed by Sessions Court, the correct remedy now is to continue with complaint proceedings in the lower court. Since statements u/s 200/202 CrPC and evidence of witnesses are recorded, the matter is at the stage of arguments. You should press your arguments strongly before the Magistrate for summoning of accused under Sections 376/323/325 IPC. If the Magistrate dismisses the complaint, you can then challenge the dismissal order before the Hon’ble High Court by way of a criminal revision or petition u/s 482 CrPC. Therefore, for now, focus on the arguments stage and be ready with supporting evidence and citations.

Aapka case kaafi technical aur serious stage par hai. Jab police ne Final Report (FR) file ki thi aur aapne uske khilaf protest daala tha, uske baad court ne ise complaint case treat kar liya. Abhi aapne revision bhi try kiya jo dismiss ho gaya, aur matter ab 376, 323 IPC ke allegations ke saath arguments pending hai. Ye ek critical stage hai kyunki yahan par court ka decision aapke poore case ka direction tay karega. Chhoti si bhi legal lapse yahaan aapke khilaf jaa sakti hai. Isme ek experienced advocate hi proper strategy bana sakta hai jaise ki: Arguments ke dauraan kis ground ko highlight karna, Kaise earlier FR aur revision ki rejection ka effect balance karna, Aur kaise charges ko frame/discharge stage par influence karna. Agar aap khud ya general guidance ke basis par chalenge to matter weak ho jaayega. Mai aapke liye is stage par direct intervention karke case ko majboot bana sakta hoon aur aapko clear legal strategy de sakta hoon. Aap mujhe authorize kijiye, fir mai poora roadmap bataunga ki aapke favour me proceedings kaise turn ki jaa sakti hain. — Adv. Vaibhav Sangam Mishra (High Court, Uttar Pradesh)
