Requsting for geting sollution for fake product selling

Sir as im purchased a smartphone from a (*) mobile shop and the shop owner told me that its a new mobile. But after 2 days I had check my mobiles IMEI activated date through that company app and the mobile is alrdy activated before I purchase. and the shop owner is cheated me and sold me a used mobile. So how should I go against him through the legal way from court.

Dear Sir, You can lodge a complaint with Police and see that FIR is registered otherwise you may go to consumer forum after issuing legal notice. You may claim some amount towards mental torture also. You may also put ratings in the social network.
