Request for advice regarding a withdrawn FIR

29-Jul-2025 (In Criminal Law)
Hi I filed a FIR against my family. But due to pressure I wrote some things about other people which I know aren't true. I filed a withdraw as well but the reason in that withdraw from may not have translated properly. I need to know what steps I can take to make sure that this FIR is not used.

You should immediately give a written statement to the same police station explaining that clearly that the allegations were false and made under pressure. Then, file an affidavit before the concerned Magistrate stating that truth and requesting closer. You can also approach the High Court under section 482 CrPC to get the FIR quashed as False. Act quickly to avoid further legal complications.

Response: To ensure the FIR is not acted upon, submit a fresh detailed written representation to the police station explaining the truth, stating clearly that the FIR was filed under pressure and contains incorrect facts. Also, file an affidavit stating the same and request closure under Section 169 CrPC (if no evidence found). You can also approach the Magistrate under Section 482 CrPC for quashing the FIR. Consult a lawyer for proper drafting and to ensure your version is properly recorded.

Once an FIR is registered, police are bound to investigate, and withdrawal is not automatic. Since you say some facts are not true and you filed a withdrawal, you must immediately give a written statement/affidavit to the Investigating Officer and also move an application before the Magistrate under Sec. 482 CrPC (quash petition) or for compounding depending on the offence. If the case is family-related, courts usually encourage settlement. Timely legal steps are very important here to ensure the FIR is not misused, so please seek legal assistance without delay.
