Request Dissmisal of case to the Court

21-Aug-2023 (In Criminal Law)
I had filed a complaint 3 months ago. The trial is beginning now and I don't have time, will, funds to indulge in the case proceedings now. Is there a way to get out of the court proceedings now without criminal charges being issued against me in the future by the accused or those in custody

If you don't wish to continue with your criminal complaint then you can always withdraw the same in the court or if you are in contact with the accused persons then you can also execute a settlement deed with them. And you must withdraw the same with the liberty to file again. For more legal assistance I am just a call away.

For this you have to specify the nature of criminal charges which are under trial. if the same is compoundable in nature...the same can be compounded with your consent and the case may be withdrawn if it is a complainant case and if an FIR has been registered by you against the accused persons the same can be quashed through a petition before the honourable High Court. And you can also execute a formal settlement deed with the accused persons in order to avoid any further proceedings against you on the same cause of action or same facts. once the wheels of justice are put in motion, they cannot be stopped on the whims and fancies of complainant. however there are some offences which are compoundable by the court meaning that if parties settle the matter, court can stop the proceedings against accused. depends on the severity of the crime though.

if in your case of complaint there has been an arrest then there must be an FIR filed by the police. in that case you will have to appear as a witness if the police is producing their list of witness. No one can tell you if the accused persons file or do not file any complaint against you. if that is done then you can always procure an anticipatory bail for you and your lawyer can appear in the court

Kindly give a brief description of the case filed by you and in which court you have filed the said case. If that is a simple case then it can be easily withdrawn and the charges will be very less as you already mention you don't have funds and will to continue with the case.
