Removing flour mill just opposite to our house

After many complaints we r still facing the issue of flour mill ( sound issue) owner harassing and defaming us.My family having 4 senior citizens facing critical health issues since since 2020 and also facing cold War like situations since 2020.Many complaints already lodged in resp. Departments ,mcd, NGT , sdm office but result are unsatisfactory. Plz help us coz we are facing financial ,physical,mental problems

you may file a suit before the competent court for injunction on the flour mill to not cause hardship and needless inconvenience to you. the flour mill indeed has the righ to work, but it cannot extend to causing inconvenience and hardship as is being caused to you and your family. various aspects need to be looked into like whether the flour mill has the appropriate permits to operate in the area, etc., after which a call to initiate appropriate proceedings like criminal complaint, complaint before municipal corporation, etc. can be taken.

You may get a legal notice issued through a lawyer restraining them from running the commercial activities in a residential colony. Further you can file a complaint with the police against this annoyance and defamation.

First of all you need to send a compulsory legal notice to the defaulter in which you must write to stop all these harassment or face legal action. After that if he’s ready to do the needful then it is well and good and if not then you have to file for registration of FIR under section 156(3).For more legal assistance I am just a call away.
