Regular Bail Sureity details required

09-Mar-2023 (In Criminal Law)
Hi , in my 498a case , charge sheet filed before court in 2019 mid and we took Anticipatory bail after case filing but now as charge sheet already submitted in lower court long back so i have 2 questions here. 1. Do we need regular bail as charge sheet filed though we already have AB. 2. We don't have sureity for regular bail so my advocate providing me the sureity from his side , is this legal and ok to get it from his side ? Any issue with that in future?

Dear Sir,
You have to get regular bail again. If your advocate is providing genuine surety then you can go for it. In many times surities are bogus and you will be also held responsible. Please cross check the documents produced by surety.

Hi,

your advocate can get surety from his side since he will be knowing the procedure of the same. there will be no issues.
and also you will have to comply with the conditions which are stated in anticipatory bail orders

in all criminal cases regular bail has to be obtained even though you have anticipatory bail but it's necessary you have to take regular bail in the trial court and it's a normal procedure so hence What your advocate is doing is right
