Regarding IPC 376 Under Barrackpore Sub Divisional Court

Car parking issue & Unsocial activities in her house. She made an complainant and after investigation, police filed chargesheet under section 376. Now the police arrested the accused after 4 months from the day complainant lodged. She refused for medical test in respect of ipc 376. No witness is there. All know the incident occured owing to car parking issue. Please explain what wiil happen as an outcome from trial at the end from your experience

very difficult to predict any outcome of a trial especially when someone is not working on the case because it is one thing to hear from some other person and it is completely different to deal with the case by oneself after perusing the case record. nevertheless whatever has been stated so far surely goes in favour of the man who is arrested. it is also suggested that one should not wait for the trial to conclude and must explore the option of either discharging the accused or quashing the proceedings. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi), Advocate, High Court, Calcutta.

Nothing will happen to the accused if the case is lodged with false ground as there will be no evidence againts the accused. The accused of thie case will be acquited at the end of trial. In such situation the complaint will not be able to show any valid evidence before the court of law. Thus the accused will be acquited easily.
